Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the ClaimLog application and this related website (together, the “Service”). By downloading, installing, or using ClaimLog, you agree to these Terms. If you do not agree, do not use the Service.
1. What ClaimLog is
ClaimLog is a personal productivity / field-notes tool intended to help independent adjusters and loss inspectors capture voice notes, organize them by Claim and Claimant, structure damage findings and estimate amounts, export field work papers, and manage personal reminders. ClaimLog is not a formal appraisal, proof-of-loss, or carrier claims platform, is not a Xactimate-style estimating cloud or carrier claims core, does not provide automatic electronic seals or certified multi-point compliance reports in the current product, and does not provide purchase, valuation, or legal advice.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering a binding agreement. The Service is designed primarily for adult professionals in the insurance adjusting / loss inspection trade who choose to use a personal memo tool.
3. Your professional responsibilities
You acknowledge and agree that:
- You are solely responsible for the content you record, type, store, or sync using ClaimLog.
- You remain responsible for compliance with applicable licensing, disclosure, consumer, and data-security duties in your jurisdiction.
- ClaimLog does not replace your judgment, formal appraisals, proofs of loss, settlement authority, or carrier adjudication systems, or institutional systems.
- PDF exports are loss inspection / estimate memo work papers you create — not formal appraisals or executed proofs of loss and not a substitute where local law requires a signed report.
- Follow-ups and to-dos shown in the app (including local notifications or optional Apple Calendar / Reminders entries) are convenience features only. You must independently verify critical dates and professional obligations.
- AI-generated zone drafts, findings, and repair estimates may contain errors; you must review and confirm before relying on them.
- Repair dollar amounts and credit memos are rough personal estimates only — not guaranteed repair costs or appraisal opinions.
4. Account and access
The current version of ClaimLog does not require an ClaimLog-hosted user account. Access is through the Apple App Store / Apple platforms under your Apple ID and device. You are responsible for maintaining the security of your device and Apple account.
5. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use ClaimLog on Apple devices you own or control, as permitted by the App Store Terms of Use / Apple Media Services Terms and any applicable Licensed Application End User License Agreement (standard Apple EULA unless we provide a custom EULA).
You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the Service except to the extent such restriction is prohibited by law.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Attempt to disrupt, probe, or compromise the Service, related websites, or other users’ devices;
- Misrepresent the Service as a formal appraisal, settlement authority, proof of loss, or carrier claims platform;
- Upload or process content you do not have the right to handle on your device.
7. User content
“User Content” means audio, text, property and client metadata, zone notes, findings, repair items, photos, reminders, to-dos, and other materials you create or store in ClaimLog. As between you and us, you retain ownership of your User Content. You grant us only the limited technical rights needed to operate features you enable on your device (for example, writing a reminder to Apple Calendar when you turn that setting on). We do not claim ownership of your site-walk notes.
8. Third-party services
ClaimLog relies on Apple frameworks and services (including but not limited to microphone access, Speech recognition, notifications, EventKit for Calendar/Reminders, Maps where used, and App Store distribution). Your use of those services is also subject to Apple’s terms and policies. We are not responsible for outages, accuracy limits, or policy changes of third-party platforms.
Speech recognition quality may vary (accents, noise, field terminology). Transcripts may contain errors. You should review important text before relying on it.
If you enable optional AI organization, you also agree to the terms of the AI provider you configure. We do not operate those models and are not responsible for their outputs.
9. Optional paid features
The Service may include free local recording and organization features, with optional paid features (for example, Pro unlock for unlimited active properties, full field work paper PDF, private backup, or AI-assisted organization when using your own key). Pricing, one-time unlocks, and refund rules are disclosed in the App Store product page and/or in-app purchase sheets and are governed by Apple’s payment terms as applicable.
10. Privacy
Our handling of information is described in the Privacy Policy, which is incorporated into these Terms by reference.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NOTIFICATIONS, TRANSCRIPTS, PDF EXPORTS, OR AI DRAFTS WILL BE COMPLETE OR ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR INSPECTLOG IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Without limiting the above, we are not liable for missed appointments, disclosure failures, licensing disputes, regulatory actions, repair cost shortfalls, or professional disputes arising from reliance on the Service.
13. Indemnity
You agree to defend, indemnify, and hold harmless us and our affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your misuse of the Service, or your violation of these Terms or applicable professional duties — except to the extent caused by our willful misconduct.
14. Termination
You may stop using ClaimLog at any time by deleting the app. We may suspend or stop providing the Service or updates if required by law, platform rules, or if we discontinue the product. Sections that by their nature should survive (including ownership of User Content, disclaimers, limitations, and indemnity) will survive termination.
15. Changes to the Service and Terms
We may update the Service and these Terms from time to time. The “Last updated” date will change when we post revisions. Continued use after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
16. Governing law
These Terms are governed by applicable law (without regard to conflict-of-law rules), except that mandatory consumer-protection laws of your place of residence may still apply where they cannot be waived, and Apple’s App Store terms may also apply to distribution. Any dispute arising from these Terms shall be brought in a court of competent jurisdiction, subject to any non-waivable rights you may have.
If you need governing law or venue adjusted for App Store distribution in a specific region, contact us before relying on this section commercially.
